Description of the service and status of intermediary

Profalia is a digital contact and intermediation technological platform that connects individuals and companies looking for home and construction services (hereinafter, “Users” o “Customers”) with professionals and independent companies in the sector that offer them (hereinafter, “Professionals”).

Legal nature of Profalia and Contractual Bond: Profalia acts as a provider of technological intermediation services and manager of the guaranteed service bond system. Profalia provides an environment for closed pricing and protection of agreed funds. Profalia DOES NOT directly execute the material works, but guarantees compliance with the agreed payment and escrow guarantees.

The contractual relationship for the execution of any work or service is formalized between the User and the Professional under the intermediation and guarantee guarantees of Profalia.

The platform's functionalities are limited to:

  • Publication and reception of service requests between users and professionals in the sector.
  • Unlocking contact data of potential customers (leads) through subscription or individual purchase.
  • Digital messaging, budgeting and agenda tools between the parties.
  • Digital directory of professionals with customer opinions and ratings.

What does verification NOT cover? The verification seal DOES NOT replace construction inspection nor does it exempt the professional from his strict responsibility for the technical skill, punctuality or final quality of the works or repairs carried out.

Liability for defective work or damage: If a professional performs unsatisfactory, defective, incomplete work or causes damage, The legal, civil and contractual responsibility falls 100% directly on said professional. . Profalia intervenes as a mediator under the rules of the service bond to retain or return funds in guaranteed deposit.

Budgets and contracts

The quotes sent through the platform constitute a binding offer from the Professional to the User. Once a quote is accepted by the User, a service provision contract is deemed to have been concluded between both parties.

It is important to keep in mind that:

  • Profalia supervises compliance with the conditions agreed under the guaranteed bond program.
  • Budgets must include a breakdown of materials, labor, deadlines and warranty conditions.
  • Any modification to the original quote must be expressly accepted by the User.
  • Disputes regarding performance of the contract will be resolved as set forth in the dispute resolution section.

Payments, subscriptions, credits and refund policy

For Users / Clients: Publishing quote requests, receiving proposals and using the contact tools are completely free. Payments for the contracted services are settled directly between the User and the Professional in accordance with the agreement between them.

For Professionals: Access to the marketplace and contact with potential clients is articulated through two modalities:

  • Periodic subscription: Monthly fee that grants a recurring package of contacts and outstanding visibility in the directory.
  • Individual unlocking of leads / Credits: Timely acquisition of the right to view verified contact details (telephone, email and full address) of a specific request, subject to a strict limit of a maximum of 3 professionals per request to preserve the quality of contact.

Cancellation and Withdrawal Policy

1. Cancellation of Subscriptions:

The professional can cancel the automatic renewal of their subscription at any time through the Payments section of their dashboard or through the Stripe Billing Portal. The cancellation will take effect at the end of the monthly period already paid, maintaining access to the functions contracted until said date. No prorated refunds will be issued for unused fractions of the month.

2. Unlocking Leads and Waiver of the Right of Withdrawal:

In accordance with article 103, letter m) of Royal Legislative Decree 1/2007 and Directive 2011/83/EU on consumer rights, the supply of digital content or service not provided in material support whose execution has begun with the prior express consent of the consumer entails the loss of the 14-day right of withdrawal . By pressing the unlock or payment button for a lead, the professional expressly requests the instant execution of the service and recognizes that, once the client's contact information is shown, the refund will not be issued due to simple regret.

3. Real Data Guarantee (Refund of Invalid Leads):

If the contact details of a request turn out to be demonstrably non-existent or fraudulent (deregistered telephone number, permanently bounced email or false request), the professional may request a refund of the amount paid by communicating to the support team within the 48 hours after unlocking . After verifying the incident with the issuing client, Profalia will refund 100% of the lead price in the form of an account balance/credit or by credit to the card or PayPal account of origin.
